Welcome to GenWell Rx. These Terms of Service (“Terms”) govern your use of our telemedicine and medical wellness services, including our website, SMS communications, and all related services. By accessing or using our services, you agree to be bound by these Terms.


PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICES.


1. Acceptance of Terms

By creating an account, accessing our website, or using any GenWell Rx services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use our services.


2. Eligibility and Age Requirements

Age Restriction (18+)

You must be at least 18 years of age to use GenWell Rx services, including SMS communications. By using our services, you represent and warrant that you are 18 years or older and have the legal capacity to enter into this agreement.

If we discover that a person under 18 has provided personal information, we will delete that information immediately.


Additional eligibility requirements:

  • You must provide accurate, current, and complete information
  • You must reside in a jurisdiction where we are licensed to provide services
  • You must not be barred from receiving services under applicable laws


3. Description of Services

GenWell Rx provides telemedicine and medical wellness services, including:

  • Weight Loss Treatments (Semaglutide, Tirzepatide, and Phentermine therapies)
  • IV Hydration Therapy (customized intravenous nutrient and hydration treatments)
  • NAD+ Treatments (nicotinamide adenine dinucleotide therapy)
  • Vitamin Injections (intramuscular vitamin and supplement injections)
  • Laboratory Testing (medical diagnostic and wellness testing services)
  • Telemedicine Consultations (virtual healthcare provider consultations)


3.1 Not Emergency Services

IMPORTANT: GenWell Rx services are not intended for emergency medical situations. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.


3.2 Professional Medical Judgment

All medical services are provided by licensed healthcare professionals who exercise independent professional judgment. GenWell Rx does not practice medicine and does not interfere with the practice of medicine by our healthcare providers.


4. SMS Communication Services – Terms and Use Cases


4.1 Description of SMS Use Cases

GenWell Rx uses SMS text messaging to communicate with patients for the following purposes:

Appointment & Treatment Management:

  • Appointment confirmations and reminders
  • Rescheduling notifications
  • Pre-appointment preparation instructions
  • Post-treatment follow-up messages

Medical Information & Updates:

  • Prescription status updates
  • Lab result availability notifications
  • Medication reminders and instructions
  • Treatment plan updates
  • Provider consultation scheduling

Account & Service Information:

  • Account verification and security alerts
  • Payment confirmations and billing reminders
  • Service delivery updates (e.g., shipment tracking)
  • Important policy or service changes

Promotional & Educational Content (Opt-In):

  • Special offers and promotions
  • Wellness tips and health education
  • New service announcements
  • Patient success stories and testimonials


4.2 Message Frequency Disclosure

Message frequency varies based on your treatment plan, appointment schedule, and communication preferences:

  • Active Treatment: 5–15 messages per month
  • Maintenance Phase: 2–5 messages per month
  • Promotional Messages: Up to 4 messages per month (opt-in only)
  • Urgent Updates: As needed for time-sensitive medical or account information


4.3 Message & Data Rates Disclosure

Message and data rates may apply. Standard text messaging rates from your mobile carrier apply to all SMS communications from GenWell Rx. GenWell Rx does not charge for SMS messages, but your carrier may charge you based on your plan.

If you have questions about your mobile plan or messaging charges, please contact your mobile carrier.


4.4 Opt-Out Instructions

You may opt out of SMS communications at any time using any of the following methods:

  • Reply STOP to any message from GenWell Rx
  • Email a request to support@genwellrx.com (include your phone number)
  • Call (757) 555-0123 and request to opt out
  • Update your communication preferences in your patient portal

After opting out, you will not receive promotional messages but may still receive essential account-related communications as required.

Consent is not required as a condition of purchase. SMS communication is optional. By opting in, you provide express written consent to receive SMS messages at the phone number provided and certify that you are the authorized user of that number.


5. Carrier Liability Disclaimer

GenWell Rx and its SMS service providers are not responsible for delayed or undelivered messages due to carrier issues, service interruptions, spam filtering, coverage limitations, or carrier-imposed charges.


6. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. You agree not to misuse the services or provide false information.


7. Medical Disclaimers and Limitations


Registration alone does not create a doctor-patient relationship. Medical outcomes are not guaranteed, and all treatments carry potential risks. You agree to provide informed consent before treatment.


8. Payment Terms and Billing

You agree to pay all fees as disclosed at the time of purchase. Some services are subscription-based with recurring billing until canceled.


9. Privacy and Data Protection

Your personal and health information is protected under our Privacy Policy. We comply with HIPAA and applicable privacy laws and do not sell personal information.


10. Intellectual Property

All content is the property of GenWell Rx and protected by intellectual property laws. Unauthorized use is prohibited.


11. Limitation of Liability

To the maximum extent permitted by law, GenWell Rx shall not be liable for indirect, incidental, or consequential damages arising from your use of our services.


12. Indemnification

You agree to indemnify and hold harmless GenWell Rx from claims arising from your use of the services or violation of these Terms.


13. Dispute Resolution and Arbitration

Disputes will be resolved through binding arbitration under Virginia law, with a waiver of class actions.


14. Changes to Terms of Service

We may modify these Terms at any time. Continued use constitutes acceptance of the updated Terms.


15. Termination

Either party may terminate the account. Certain provisions survive termination.


16. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.


17. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and GenWell Rx.
